Trademark Registration in Cambodia
How to register a trademark in Cambodia, the steps, duration and why first-to-file matters.
A trademark protects your brand name, logo or slogan so that others cannot use something confusingly similar.
Why register
Cambodia works on a first-to-file basis, which means the first applicant to register usually gets the rights. Registering also gives you a legal basis to stop counterfeiters and to license your brand.
What can be registered
names, logos, slogans, shapes, and combinations, provided they are distinctive and not misleading or against public order.
Steps
- Search for existing marks that are similar to yours
- Choose the classes of goods and services you need (based on the Nice classification)
- File the application with the Ministry of Commerce, with a power of attorney if a representative files for you
- Examination: the office checks formalities and conflicts
- Publication and opposition period, if required
- Registration certificate is issued once approved
Duration and renewal
registration lasts for a fixed term, commonly ten years, and can be renewed. Keep a calendar reminder.
Foreign brands
Cambodia is part of international systems for trademarks, so foreign owners can file through an agent or through the international route.
Tips
- File before you launch or start importing under your brand
- Register your logo and your name separately if they are important
- Keep proof that you use the mark
Fees and steps change. Check with the Ministry of Commerce or an IP lawyer.
