Business ownership

Foreigners can generally own and operate companies in Cambodia, including 100% foreign-owned companies in most sectors. Some activities are restricted or need a local partner, so check your sector before you invest.

Land ownership

The rules are different:

  • Land can generally only be owned by Cambodian citizens or by companies that are majority Cambodian-owned
  • Foreigners cannot own land directly in their own name
  • Foreigners and foreign companies can lease land on a long-term basis
  • Foreigners can own condominium units above the ground floor of qualifying buildings, within the limits set by the law

Common ways foreigners hold property

  1. Long-term lease: a registered lease for an extended period
  2. Condominium (strata title): owning a unit in a qualifying building
  3. Local company structure: a company that is majority Cambodian owned. This carries legal risks if it is only a nominee arrangement, so take professional advice

Tips

  • Always check the title (hard title is the strongest form of land ownership proof)
  • Use a licensed lawyer, not only the agent
  • Register the lease or purchase with the land authority
  • Do not rely on verbal agreements

Foreign ownership rules are specific and change. Get legal advice before you pay.
